1. Acceptance of Terms

By downloading, installing, or using the PerfectSkin application ("the App"), developed by Deepsense Sports Tech Private Limited ("we," "us," or "our"), you agree to be bound by these Terms of Use and the Apple Standard Licensed Application End User License Agreement ("Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree to these terms, do not use the App.

2. Medical Disclaimer

NOT MEDICAL ADVICE

The skin analysis and recommendations provided by the App are generated by Artificial Intelligence for informational purposes only. The App is not a medical device and does not provide medical diagnosis, treatment, or prevention of any skin disease or condition.

Always seek the advice of a qualified dermatologist or medical professional regarding any skin concerns. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in this App. Reliance on any information provided by the App is solely at your own risk.

3. Description of Service

PerfectSkin provides an AI-powered assistant ("Avni") that analyzes facial images provided by the user to identify skin concerns and suggest personalized skincare routines. We use advanced AI models (including OpenAI) to process your data and provide these insights.

4. Intellectual Property & License

We grant you a personal, non-exclusive, non-transferable, non-sublicensable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.

All content, features, and functionality of the App (including names, logos, AI models, and UI design) are the exclusive property of Deepsense Sports Tech Private Limited.

5. Subscriptions & Payments

The App offer premium features through auto-renewing subscriptions managed via Apple ID.

  • Billing: Payments are processed through the Apple ID account at the time of purchase confirmation.
  • Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Management: You can manage or turn off auto-renew in your Apple ID Account Settings at any time after purchase.
  • Refunds: All payment transactions are handled by Apple. Please contact Apple Support for refund requests.

6. User Responsibilities

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or extract the source code of the App.
  • Upload images that are not your own or for which you do not have permission.
  • Provide false information in questionnaires.

7. Apple Specific Terms

As required by Apple, you acknowledge and agree to the following:

  • Parties: This agreement is between you and Deepsense Sports Tech Private Limited, not Apple. Apple is not responsible for the App or its content.
  • Maintenance: Deepsense Sports Tech Private Limited is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide such services.
  • Warranty: Safe as provided in these terms, we are solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price.
  • Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession/use of the App.
  • Third Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

8. Limitation of Liability

To the maximum extent permitted by law, Deepsense Sports Tech Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
